PENDAHULUAN

Kita sepakat bahwa minyak dan gas bumi (migas) merupakan sumber daya alam strategis tidak terbarukan yang dikuasai oleh negara serta merupakan komoditas vital yang menguasai hajat hidup orang banyak. Migas mempunyai peranan penting dalam perekonomian nasional sehingga pengelolaannya harus dapat secara maksimal memberikan kemakmuran dan kesejahteraan umum. Hal yang demikianlah yang menjadi dasar filosofis diaturnya kegiatan pengelolaan migas baik disektor hulu maupun hilirnya.

Atas pandangan tersebut diatas, pemahaman komprehensif tentang hukum minyak dan gas bumi Indonesia (Indonesia Oil and Gas Law) sangat dibutuhkan oleh pelaku usaha migas (hulu dan hilir) dan berbagai pihak yang terkait dengan bidang usaha migas.

Untuk itu, Kami kembali menyelenggarakan Kursus Intensif Hukum Minyak dan Gas (KIH Migas), dalam rangka memfasilitasi para pelaku usaha migas agar lebih memahami aspek hukum migas secara mendalam. KIH Migas ini disusun dengan beranjak pada reformasi atau penyempurnaan terhadap beberapa topik pada KIH Migas sebelumnya agar lebih sesuai dengan situasi dan kondisi dunia bisinis di bidang migas saat ini. DESKRIPSI

Secara  singkat,  pengolahan  adalah  kegiatan  memurnikan, memperoleh
bagian-bagian,  mempertinggi mutu dan mempertinggi nilai tambah minyak
bumi dan atau gas bumi, tapi tidak termasuk pengolahan lapangan.
Pengolahan  minyak  mentah  dilakukan  pada kilang minyak bumi sebagai
sistem  peralatan  untuk  mengolah minyak mentah (minyak bumi) menjadi
berbagai  produk  kilang.  Produk  hasil pengolahan minyak bumi berupa
berbagai  jenis  BBM  dan  produk-produk non BBM, antara lain naphtha,
bensin,  kerosene, minyak diesel, bahan pelumas, minyak bakar, residu,
LPG, bahan kimia, oli, lilin dan aspal.
Kegiatan  pengangkutan  migas  adalah kegiatan pemindahan minyak bumi,
gas  bumi  dan  atau  hasil olahan dari wilayah kerja atau dari tempat

Kegiatan  penyimpanan  migas  adalah kegiatan penerimaan, pengumpulan,
penampungan  dan pengeluaran minyak bumi dan atau gas bumi, BBM, bahan
bakar  gas  dan  atau  hasil  olahan pada lokasi di atas atau di bawah
tanah  untuk  tujuan  komersial,  misalnya  depot  dan  tangki  timbun
terapung (floating storage).
Usaha  penyimpnan  BBM  maupun  gas  (LPG,  LNG)  di  Indonesia  telah
melibatkan   peran   swasta   dan   badan  usaha  milik  negara  dalam
pembangunannya,  untuk  mendukung kecukupan suplai kebutuhan BBM mapun
gas di tiap wilayah.

DESCRIPTION

Instrumentation  is  the use of measuring tools to monitor and control
the  process.  It  is  the  art and science of measurement and control
variables  in  the  production  process,  laboratory, or manufacturing
areas.
Instruments used for oil & gas companies are some devices that measure
physical quantities such as flow, temperature, level, distance, angle,
or  pressure.  These  instruments  may  be  as  simple  as  reading  a
thermometer   directly  or  may  be  complex  multi-variable  analysis
process.  Instruments  are  often found in parts of control systems in
refineries  –  oil refinery in the oil & gas companies, factories, and
vehicles.  Process  control is one of the main branches are applied in
instrumentation.  This  instrumentation  can  also refer to a handheld
device    that    measures   several   variables   desired.   Handheld
instrumentation  common variety in the laboratory, but can be found in
the  household as well. For example, the smoke detector is a tool that
is commonly found in most homes west.
Instruments  attached  to  the control system and can provide a signal
which  is  used  to  operate  the solenoid, valve, regulator, fuse, or
relay.  This device controls the desired output variables, and provide
the  ability  to  both  remote  and  automatic  control. This is often
referred  to  as the final control element when controlled remotely or
with the control system.

Introduction
This intensive Course of Oil & Gas Law constitutes a comprehensive course to deepen our knowledge in legal aspects of oil & gas industry. This Workshop will be held in Indonesian language and presented by the combination of oil and gas law experts and government officer who have handled case and involved in oil and gas industry for many years. This Course is designed to be presented intensively in order to provide deep understanding to all participants about oil & gas industry and the development of relevant laws and regulation.

After the Course, the participant will be expected to have legal skill in order to understand legal aspect of oil & gas including understanding of: (I) many kinds of common contract in oil and gas industry (TAC, PSC, JOB, JOA, EOR); (ii) the role and authority of Oil and Gas regulating Body (I.e. BP Migas and BPH Migas; (iii) how to proceed a mining area of oil and gas; (iv) various obligations of the contractor to the government; (v) characteristic of upstream and downstream activities (exploration, exploitation, processing, transportation, storage and trading); (vi) relinquishment activities, land clearing;  (vii)  cost recovery, AFE, Work Program and Budget, P.O.D, ROW; (viii) technique to acquire license to borrowing and use of forestry area (Ijin Pinjam Pakai Kawasan Hutan)  (ix) various regulations and critical issues to be understood in conducting legal audit; and (ix)  various restrictions and regulations to conduct merger and acquisition.
